In compliance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE), the User is informed that, depending on the accommodation selected, the booking service may be offered by:

When the user selects the booking, the name of the company that will process the booking will be indicated. Likewise, references to “Holiday Homes Málaga” will be understood to apply to both companies.

Applicable regulations

The legal relationship between the parties is governed by Spanish law and specifically by the provisions of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE) and by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users (TRLDCU).

These General Terms and Conditions, the text of which is written in Spanish, may be stored and reproduced at any time by the User who makes a reservation, and must be accepted before proceeding to payment. Likewise, in the confirmation email that we send you, we will include a link to these General Terms and Conditions.

Legal capacity

Reservations may only be made by persons over 18 years of age who have the legal capacity to commit themselves.

Booking process

To book online, you must select the property and include the requested information. In this first step, a first payment must be made online by credit/debit card, which represents 20% of the total amount of the price.

In the event that the credit card provided is not valid and such a charge is not possible by Holiday Homes Malaga, a member of our team will contact you on the contact telephone number or email address you have provided. If it is not possible to contact you via the contact information provided, the booking may be cancelled. In this case, we will send you an email confirming the cancellation.

Once the initial payment has been made, the booking will be confirmed and you will receive a welcome email with all the details of your booking (booking details, flat address, contact person details, etc.).

Final payment: the remaining 80% of the amount will be charged on arrival, either by credit card or cash.

If you make a reservation less than 4 days in advance, 100% of the amount will be charged after the reservation has been made and you will also receive an e-mail when the payment has been made with all the details of your reservation.

Holiday Homes Malaga will charge a damage deposit depending on the property, between 250 € and 2000 €, which will be returned at the end of the rental period if everything is in the same conditions.

Minimum stay

The minimum stay is 5 days.

Check-in and check-out

Check-in time for the flats is from 15.00 to 22.00 hours and from 17.00 to 22.00 hours for the villas.

Check-out time for the flats must be before 12 noon on the scheduled day of departure and 11 a.m. on the scheduled day of departure for the villas.

Extra charge of €40 for check-in after 22:00 hours.

Price and payment methods

Prices are always shown in EUROS (€) and may vary depending on the time of year or special events, depending on each of the flats. Therefore, Holiday Homes Malaga reserves the right to change them, updating them automatically on the website.

Payment is made by credit/debit card. The card information will be sent directly to the payment service provider. With this payment method Holiday Homes Malaga does not collect or process any User data relating to the card number. All data is processed directly by the payment service provider so that Holiday Homes Malaga always offers the greatest transparency and confidentiality in the transaction.

Cleaning and supplies

The normal costs of electricity, gas and water produced during the stay are included in the rental price. The flat is cleaned before each guest arrives and is provided with sets of bed linen and towels.

We do a cleaning service and a change of the set of sheets and towels if your stay is 12 days or more. However, if your stay is less than 12 days, we also offer an additional cleaning service and change of towels and sheets on request for the price of 40€.s aceptables de orden y limpieza.

Lost and found objects will be kept for a period of 3 months.

Booking cancellations

Holiday Homes Malaga will only accept cancellations via email 2 days prior to arrival. Failure to arrive on the agreed date without written notice of cancellation may result in a charge for the full stay.

Refunds

In the event that it is necessary to process the refund of the reservation made, the process will be processed within 14 calendar days following the cancellation request, through the same means of payment used by the Client.

Modifications to reservations

In the event that the client decides to change or modify the dates of arrival/departure or the number of persons accommodated in a confirmed booking after the booking has been made, Holiday Homes Malaga will apply the price established on the website for that number of persons or those dates and will charge the difference if any.

If an accommodation cannot be occupied for unforeseen reasons not attributable to Holiday Homes Malaga, Holiday Homes Malaga will contact the client as soon as possible and will try to find an alternative, making available another accommodation of equal or superior characteristics. If the aforementioned option is not possible, or if the client does not accept the change or modification, the reservation will be cancelled and the total amount paid will be refunded immediately. No further claims or complaints on your part will be admissible in these cases.

Responsibilities

Holiday Homes Malaga shall in no case be liable for events arising from force majeure or unforeseen circumstances, such as:

  • Electricity outages not related to the property.
  • Noise caused by building work near the reserved dwelling.
  • Natural disasters.
  • Lift breakdown.
  • Other events not related to the functions, qualities and description of the property.

The client undertakes to respect the rules of the flat, especially the hours of rest. It is not permitted to use the property for party celebrations that may disturb the rest and tranquillity of the neighbourhood. Under no circumstances is it permitted to occupy the dwelling for more people than the maximum capacity established. The Client undertakes not to carry out dangerous, offensive, noisy, illegal or immoral activities in the property, as well as any act that could create unrest among the neighbours. You will be responsible for the cost of any damage caused by you or a member of your party.

In the event of any breach of the aforementioned obligations, the Client must leave the property at the request of Holiday Homes Malaga without any right to financial compensation.

It is the Customer’s responsibility to ensure that the necessary precautions are taken against burglary: lock the door and close all windows when you are not at home etc.

Truthfulness of information

All information provided by the User must be truthful and accurate. For these purposes, the User guarantees the authenticity of all data provided as a result of completing the booking process. Similarly, it is the responsibility of the User to keep all the information provided to Holiday Homes Malaga up to date, so that it corresponds, at all times, to his or her real situation. In any case, the User will be solely responsible for any false or inaccurate statements made, and for any damages caused to Holiday Homes Malaga or third parties, due to the information provided. The User guarantees that he/she is the owner of the information provided in the purchase process and of the means of payment indicated, or, failing this, has a legally valid consent for its use. In the event that there are doubts about the authenticity of the data provided, Holiday Homes Malaga may request the information strictly necessary to ensure that the sale process is formalised with the maximum guarantees for the parties.

Data protection

Holiday Homes Malaga has internal procedures to ensure compliance with the obligations established in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (RGPD), as well as the provisions of the applicable national regulations on data protection. Holiday Homes Malaga uses state-of-the-art technology to protect your personal data and information and our website is stored on secure servers protected against the most common types of attacks. Holiday Homes Malaga has adopted the technical and organisational measures that guarantee the security of personal data and prevent its alteration, loss, processing or unauthorised access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed.

Online dispute resolution

The European Commission provides an online dispute resolution platform, which is available at the following link: https://ec.europa.eu/consumers/odr/ . Consumers will be able to submit their complaints through this online dispute resolution platform.

Applicable law and jurisdiction

These General Conditions are governed by Spanish law. The parties submit, for the resolution of any conflicts that may arise, to the courts and tribunals of the Client’s residence.
